4 Annual Commission Update hours

Each year, the Annual Commission Update (ACU) Course provides important information related to regulatory changes and issues affecting Colorado real estate practice.

This four-hour course meets the regulatory requirements for CO broker continuing education. It highlights compliance issues, reviews general practice knowledge, and summarizes recent regulatory and Commission changes that affect the real estate industry. In addition, it increases licensee competency so that brokers may better serve consumers.

Caveat: To ensure you're in compliance with updated rules and regulations, this course is best taken at the beginning to middle of the year! Also, the Commission would like to remind licensees that the ACU is not a contracts course. You'll want to ensure you take steps required so that you understand current contracts on a deeper level.

This course covers:

- Common compliance issues, including new rule highlights, DORA investigative statistics, top violations, and continuing education issues
- Adverse material fact disclosure, including a case study of how things can go wrong
- Intellectual property as it relates to real estate practice
- Technology and privacy issues
- Legislation impacting property management, including habitability, bed bugs, and tenant health and safety
- New forms and changes including listing contracts, bills of sale, and closing instructions
- Resources for licensees

Tactics that work with motivated, excited sellers don't always translate well when working with short sale sellers and short sale buyers. Toss lender approvals, junior lien holders, and inflexible timelines into the mix, and you end up with a whole new ball game.

In a short sale transaction, the motivation for each party is different than the standard transaction, and as the professional in the scene, you need to adjust accordingly. This course speaks to your interaction with short sale sellers, and how you can help them through a tough process while diligently advocating on their behalf. We cover how to figure out an appropriate listing price, negotiate with the lender's representative, sort through debt settlement terminology, and carry the deal through to closing. We also look at the process from a buyer's agent perspective. Additional cautions, considerations, and fraud prevention tactics are required when advocating on behalf of these deal-seeking buyers.

Affordable housing, or lack thereof, has been a discussion topic in the media, advocacy groups, and the political arena for years, and lately the chatter has become louder and more urgent. How bad is it? According to the leader of one housing coalition, “It’s not a housing crisis. It’s a housing catastrophe.” In this course, we’ll explore the impact that a lack of affordable housing has on individuals, families, and the real estate industry.

If it’s true that inside of every problem lies an opportunity, the opportunity here is huge. We’ll explore largely untapped solutions to locate housing and secure financing, even for low-income borrowers with less-than-stellar credit and little to no down payment. And in three “Bringing it Home” lessons, we’ll show how real estate professionals can become part of the solution for their clients and their communities.

Course highlights include:

- Issues that contribute to the affordable housing crisis
- Socio-economic impact of the affordable housing crisis
- Demographics and geographics of affordable housing
- Creative housing solutions
- Loan programs with minimal and no downpayment options, down payment assistance programs, and creative financing solutions
- How real estate licensees can be part of the affordable housing solution while building their business and improving their communities

Emotional support animals, service animals, and reasonable accommodation. How does the concept of reasonable accommodation play out in property management? Must a property manager accept a tenant's emotional support animal, and under what conditions? What proof can a property manager or landlord require of a tenant who claims a need for an emotional support animal? What about homeowners associations—must accommodation be made in these communities? With some airlines accepting miniature horses on board as service animals, can Apartment 3B be far behind? How does the Fair Housing Act apply, and where does it all stop? This is a topic that sparks questions around what the laws are and how and when they apply in cases of individuals with assistance animals.

This four-hour course explores the issues and options for landlords and property managers surrounding assistance animals, helping real estate professionals recognize scenarios in which the fair housing and disabilities laws apply and helping to ensure that individuals with disabilities have equal access to housing.

Course highlights include:

- An overview of the evolution of fair housing law
- A cross-comparison between the Americans with Disabilities Act and the Fair Housing Act
- Definitions related to disability and the types of assistance animals
- A diagnosis of when the Americans with Disabilities Act applies, and when the Fair Housing Act does.
- A discussion as to how to work with clients with assistance animals
- An examination of how to handle reasonable requests for accommodation
- A look at pets in property and where they’re permitted by law
- A discussion on practical application of the laws in property management scenarios
- A sampling of case studies and legal trends as this field of the law continues to evolve
- Interactive activities and scenarios to seal in the new information and frame it in everyday context
